WASHINGTON — Smoking will be prohibited in public housing developments nationwide under a final rule announced Wednesday by the Obama administration.
The Department of Housing and Urban Development has been encouraging local public agencies to enact smoking bans, and some 228,000 public housing units were already smoke-free. The new rule will expand the impact to more than 940,000 units.
In announcing the ban, administration officials emphasized the dangers of secondhand smoke to children, saying it can increase the risk of asthma, ear infections, even sudden infant death syndrome.
“Every child deserves to grow up in a safe, healthy home free from harmful secondhand cigarette smoke,” HUD Secretary Julián Castro said.
The final rule prohibits lit tobacco products in all living units and indoor common areas, and all outdoor areas within 25 feet of housing and administrative offices. The new rule gives public housing agencies 18 months to implement the ban.
The Centers for Disease Control and Prevention says the smoke-free policy will save housing agencies $153 million every year in repairs, preventable fires and health care costs. That amount includes $16 million in costs associated with smoking-related fires.
“Protecting people from secondhand smoke saves lives and saves money,” said CDC Director Tom Frieden. “No level of secondhand smoke exposure is safe, and the home is the primary source of secondhand smoke for children.”
The Campaign for Tobacco-Free Kids applauded HUD’s actions, saying “this bold step” would reduce smoking among groups that suffer the most from tobacco-related death and disease. The organization said HUD also should have gone further and applied the ban to electronic cigarettes, though local housing authorities are permitted to do so.

Ann Klassen, PhD, a professor in Drexel University's Dornsife School of Public Health, led the study that monitored nicotine levels in Philadelphia Housing Authority properties both before and after the smoke-free policy was implemented. Klassen and her team found that although the number of places where nicotine was detected remained unchanged, the levels of detected nicotine were reduced by almost half after the policy was enacted. "This is encouraging," Klassen said. "These data show a reduction in exposure to airborne nicotine, which is an indicator of reduced exposure to secondhand smoke, and, therefore, healthier air in multi-unit housing."

On Wednesday, Habitat magazine reported that a Manhattan Supreme Court judge ruled that the co-op board is on the hook to pay a co-op owner more than $120,000 in back maintenance, interest, and insurance fees because smoke from other apartments had trickled into her own living room, making her apartment unlivable and affecting her health. In his decision, Justice Arthur Engoron made it clear that he believes this is more than a quality-of-life issue: "This Court ... is only saying that if you want to avail yourself of the right to rent out residences, you assume the obligation to insure that your tenants are not forced to smell and breathe carcinogenic toxins." Public housing agencies are asking for more time and resources to put in effect a proposed federal ban on smoking that would affect nearly one million households nationwide. Officials with the federal Department of Housing and Urban Development said they had heard from the agencies, public health organizations and residents in more than 1,000 comments received over 60 days on a proposed federal rule to ban smoking inside public housing units. The officials, who announced the proposal in November, are now reviewing those comments before finalizing the rule. The New York City Housing Authority, the largest in the country with 178,000 apartments spread among 328 sites, is asking for three years, rather than the proposed 18 months, to put the ban in place.
